8. Disclaimer
The liability of GMT is excluded unless

a) according to the product liability law (Produkthaftungsgesetz),

b) due to intent or gross negligence,

c) due to injury to life, body and health,

d) due to the assumption of a guarantee of quality,

e) due to fraudulent concealment of a defect, or

f) due to the infringement of essential contractual obligations (cardinal obligations)

liability is mandatory.

However, compensation for breach of material contractual obligations (cardinal obligations) shall be limited to the foreseeable damages typical for the contract, unless caused by intent or gross negligence.

9. Subsidiary Agreements, Place of Jurisdiction, Applicable Law
9.1 Subsidiary agreements to these Terms of Use must be made in writing.

9.2 As far as the user is a businessman within the meaning of the German Commercial Code (Handelsgesetzbuch), the place of jurisdiction is the registered office of GMT in Bühl, Germany.
